Terms of Sale

Scope

These terms apply between you and DALEA, Tbilisi, Georgia, referred to here as DALEA or we. They cover the site, the waitlist, the draw, the invitation, the sale and the delivery of a piece. By registering, or by accepting an invitation, you agree to them. Any other terms, including terms you attach to a payment, do not apply unless we accept them in writing.

The Shipping page, the Guarantee page and the Privacy Policy form part of these terms and should be read with them.

The site

daleaofficial.com presents our work and hosts the registration form. We may change the site, suspend it for maintenance, or close registration for a drop at any time. Information on the site is an invitation to register, not an offer to sell. Nothing on the site creates a contract until we confirm receipt of payment as described below. You agree not to interfere with the site, to submit false information, or to register more than once.

The Allocation

Pieces are not sold on demand. They are allocated in the following way.

1. Registration. You register for a named drop by giving the details requested on the form. Registration is free, non-binding, and limited to one per person. We may cancel registrations that are duplicated, fraudulent, incomplete, or made under a false identity.
2. Closure. On the date shown on the site, registration for that drop closes. Registrations received after closure are carried to the next drop.
3. Draw. Pieces are assigned by random draw among all valid registrations. The order in which you registered makes no difference. The result of the draw is final and is not open to appeal.
4. Invitation. Chosen clients receive a personal invitation by phone and by email. You have 48 hours from the moment the invitation is sent to confirm that you wish to purchase. If you decline, or if we cannot reach you within that time, the piece passes to the next drawn name.
5. Priority. If you were not drawn, your registration stays active and is carried to the next drop, unless you ask us to remove it. Priority means that the next draw is held first among carried-forward registrations and only then among new ones.

We decide the number of pieces in each drop and the dates of registration, closure and draw, and may change them. Drop 01 consists of two pieces. No payment is ever requested at registration, and no registration obliges you to buy.

Orders and payment

Payment is requested only after you have confirmed an invitation. We accept bank transfer in Georgian lari, card payment through a secure payment link, or cash on hand-delivery in Tbilisi. For a transfer or card payment, the piece is reserved for you until the payment deadline stated in the invitation email, and the contract of sale is formed when we confirm receipt of payment in writing. For cash on hand-delivery, the piece is reserved until the agreed appointment, and the contract is formed when the piece and the payment are exchanged.

A contract of sale is formed only when we confirm receipt of your payment in writing. Until then we may withdraw the invitation, for instance if payment has not arrived by the deadline, and the piece may pass to the next drawn name. Our confirmation email is your order confirmation. Keep it with your certificate.

Prices

Prices are shown in Georgian lari (GEL) and include VAT where it applies. The price stated in your invitation is the price you pay; a later change on the site does not affect a confirmed invitation. A price shown on the site by an obvious technical error is not binding; in that case we tell you the correct price before you pay and leave the decision to you. Delivery within Georgia is included. For international delivery, the DHL Express charge is stated in the invitation before you pay. Import duties and taxes levied in the destination country are payable by the recipient and are not included.

Product variations

Every piece is made by hand from natural full-grain calfskin. Grain, shade and the exact line of a stitch or a painted edge differ slightly from piece to piece and from the photographs on the site. Colours on a screen depend on the screen. These differences are the mark of the work and are not defects. Stated dimensions and weight are approximate.

Delivery

Delivery is as described on the Shipping page. In Tbilisi a DALEA team member hand-delivers at a time agreed with you. In the rest of Georgia we send by insured courier. Internationally we send by DHL Express. Delivery times are estimates. Risk in the piece passes to you when it is handed to you or to a person you authorised to receive it. If a parcel arrives damaged, note the damage with the courier and tell us within 48 hours; this helps the insurance claim and does not affect your statutory rights.

Right of withdrawal

Under the Law of Georgia on the Protection of Consumer Rights, you may withdraw from a distance purchase within 14 calendar days of receiving the piece, without giving a reason. Tell us in writing at atelier@dalea.ge within that period; any clear statement is enough, and we send you a model withdrawal form on request. Return the piece within 7 calendar days of your notice, with its tag, certificate, dust bag and box. You may examine the bag as you would in a shop; if its value has diminished through handling beyond that, we may deduct the loss in value from the refund and will tell you before doing so. We refund within 14 days of your notice, to the payment method you used, and may withhold the refund until the piece or proof of its dispatch reaches us. Return collection within Georgia is arranged and paid by us. International return shipping is paid by you.

A piece personalised with embossed initials is made to your instruction and is excluded from the right of withdrawal. We remind you of this in writing before any embossing is done.

Guarantee

Every piece carries the DALEA Guarantee, set out on the Guarantee page. Its terms form part of this contract. Your statutory rights under Georgian consumer law apply in addition and are not reduced by the guarantee: independently of it, the Law of Georgia on the Protection of Consumer Rights entitles you to repair, replacement or a price reduction for any lack of conformity that appears within two years of delivery.

Intellectual property

The DALEA name, the DA monogram, and all photographs, films and texts on the site belong to DALEA or are used under licence. You may not copy or reproduce them for commercial purposes without our written permission. You are welcome to share images of your own piece.

Liability

We are liable for death or personal injury caused by our negligence, for fraud, and for any liability that the law does not allow us to exclude. Beyond that, and to the extent the law permits, our liability for any claim connected with a purchase is limited to the price paid for the piece, and we are not liable for indirect or consequential loss.

We are not liable for delay caused by events outside our reasonable control, including courier disruption, customs holds and force majeure. In such cases we will keep you informed and deliver as soon as we can.

Governing law

These terms are governed by the law of Georgia. Any dispute is subject to the courts of Tbilisi. If you are a consumer in the EU or EEA, nothing here removes the protection of mandatory provisions of the law of your country of residence. We prefer to resolve any concern directly, so please write to us first.

Changes to these terms

We may revise these terms. The version in force when you accept an invitation applies to that purchase. The date at the top shows the current version.
